See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 23, 2025, Mr. Berxhiku requested the following regarding [an identified individual]: [1] The full investigative report, findings, and disposition underlying the sustained misconduct determination dated June 23, 2022, reflecting[:] Classification as “Other Misconduct – Harassment”[;] [a] finding that [an identified individual] made an inappropriate sexual comment toward a subordinate employee[;] [and] [t]he imposed discipline, including retraining and suspension[;] [2] Any POST Commission records, summaries, referrals, correspondence, certifications, or determinations related to this incident, including[:] Materials received from the Billerica Police Department[;] [i]nternal POST Commission evaluations or reviews[;] [r]ecords reflecting any impact on certification status, conditions, restrictions, or monitoring[;] [3] Any attachments, exhibits, witness statements, findings of fact, disciplinary memoranda, or supporting documentation associated with the above matter[.] Claiming to not yet have received responsive records, Mr. Berxhiku petitioned this office and this appeal, SPR26/0095, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Commission has provided a response.
