Assistant General Counsel Department of Developmental Services 1000 Washington Street Boston, MA 02118 Dear Attorney Eisner: I have received the petition of David Kassel, of The Massachusetts Coalition of Families and Advocates, appealing the response of the Department of Developmental Services (Department/DDS) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 22, 2025, Mr. Kassel requested: …documents from the Department concerning the procurement of TLC Trust, Inc. to perform guardianship and other services for DDS. This request includes, but is not limited to, all current contracts between DDS and TLC. I am also requesting any documents showing payments to TLC for guardianship and other services from Fiscal Year 2022 to the present. The Department responded on January 8, 2026. Unsatisfied with the Department’s response, Mr. Kassel petitioned this office and this appeal, SPR26/0146, was opened as a result. Subsequently, I learned that the Department provided Mr. Kassel with a supplemental response on January 28, 2026. Where this appeal was opened as a result of the Department’s January 8, 2026 response, I will now consider this administrative appeal closed. Mr. Kassel may appeal the substantive nature of the Department’s January 28, 2026 response within ninety days. See 950 C.M.R. 32.08(1).
