The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records January 28, 2026 SPR26/0157 Michael Lambert Administrator Brockton Area Transit Authority 155 Court Street Brockton, MA 02302 Dear Mr. Lambert: I have received the petition of Richard Ripley appealing the nonresponse of the Brockton Area Transit Authority (Authority) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 30, 2025, Mr. Ripley requested: [1] The Video audio records, & information for the incidents on Thursday, December 4th & Thursday, December 11th 2025. On Bat Buses in which the bus drivers refused to properly secure the wheelchair of [identified individual]. [2] Information & records of the steps BAT took or initiated to address the violation of the (ADA) Americans with Disability Act including any disciplinary actions. Claiming to not yet have received responsive records, Mr. Ripley petitioned this office and this appeal, SPR26/0157, was opened as a result. Subsequently, I learned that the Authority provided Mr. Ripley with a response on January 15, 2026. Where this appeal was opened as a result of the Authority’s lack of a written response, I will now consider this administrative appeal closed. Mr. Ripley may appeal the substantive nature of the Authority’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
