Deputy General Counsel Massachusetts Parole Board 12 Mercer Road Natick, MA 01760 Dear Attorney Doherty: I have received the petition of Mr. Robert Cantell appealing the nonresponse of the Massachusetts Parole Board (Board) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On December 22, 2025, Mr. Cantell requested the following records[:] [1] A copy of [an identified individual’s] “Appeal and Reconsideration of Denial of Parole for [an identified individual] and Notice of Intent” filed on October 20, 2025 with [an identified individual], and refiled, again, on [November] 5, 2025 (after the IPO informed me that my Appeal/Reconsideration was not transmitted to the Board (for whatever reason); and[;] [2] A copy of [an identified individual’s] “entire criminal record” reference to and certified by [an identified individual] at the end of the October 7, 2025 “Record of Decision” stating “that all voting Board [members]s have reviewed the applicant’s entire criminal record[.]” Claiming to not yet have received responsive records, Mr. Cantell petitioned this office and this appeal, SPR26/0162, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Board has provided a response. Accordingly, the Board is ordered to provide Mr. Cantell with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Cantell may appeal the substantive nature of the Board’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
