Nawa Legal Assistant City of Pittsfield 70 Allen Street Pittsfield, MA 01201 Dear Ms. Nawa: On January 22, 2026, this office received your petition on behalf of the City of Pittsfield (City) seeking permission to charge for time spent segregating or redacting responsive records. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv); see also 950 C.M.R. 32.06(4). As required by law, it is my understanding that the City furnished a copy of the petition to the requestor, Lee Kohlenberger, Jr. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv)(2). On January 21, 2026, Mr. Kohlenberger requested “[e]mails between [two identified individuals].” It is my understanding that the City assigned the request reference number 26-44. Subsequent to the opening of this petition, in an email to this office and copied to the City on January 28, 2026, Mr. Kohlenberger states, “[p]lease close all open requests at this time. I am unable to pay all the fees. . . .” Conclusion In light of the above, it is unnecessary to opine on the City’s petition for permission to charge for time spent segregating or redacting responsive records.
