O Box 1327 Oak Bluffs, MA 02125 Dear Ms. Brough: I have received the petition of James T. Morse, Esq. appealing the nonresponse of the Oak Bluffs Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 28, 2025, Attorney Morse requested the following: [1] Copies of any Oak Bluffs Police Department reports concerning [an identified inccident] on or about August 16, 2025 in the Oak Bluffs Harbor specifically but not limited to a narrative report of [identified individuals][;] [2] Copies of any arrest reports for Boating Under the Influence from August 16, 2025[;] [3] Copies of video camera footage of the Oak Bluffs Harbor entrance, harbormasters shack or any other video footage provided by [an identified individual] or any Oak Bluffs Police Officer to the MEP referenced in the MEP report[;] [4] Copies of all emails submitted from any member of the Oak Bluffs Police Department to the Mass Environmental Police concerning this incident[;] [F]or the purpose of this request “records” shall include but not be limited to [written complaints][;] [log entries][;] [incident reports][;] [officer’s notes][;] [investigations][;] [training or internal memorandums][;] [special orders or personnel orders][;] and [emails][.] One Ashburton Place, Room 1719, Boston, Massachusetts 02108 • (617) 727-2832• Fax: (617) 727-5914 sec.state.ma.us/pre • pre@sec.state.ma.us

Wendy Brough SPR26/0229 Page 2 February 5, 2026 Claiming to not yet have received a response, Attorney Morse petitioned this office and this appeal, SPR26/0229, was opened as a result. Subsequently, I learned that the Department provided Attorney Morse with a response dated January 23, 2026. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed.
