General Counsel MassAbility 600 Washington Street Boston, MA 02111 Dear Attorney Defensor: I have received the petition of Samantha Lynch appealing the response of MassAbility (Agency) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 7, 2026, Ms. Lynch requested “all records maintained by MassAbility related to [her] case,” including: [1] Complete Individualized Plan for Employment (IPE) – all versions, updates, or revisions, including any made without my consent or signature. [2] All emails, memos, notes, or other internal communications discussing my case, including correspondence between counselors, supervisors, CAP representatives, or other MassAbility staff. [3] Documentation of decisions regarding educational funding, mediation/hearings, consent form, purchase orders, reimbursements, educational materials, or supplies. [4] Any case notes, internal records, or policies referenced or used in the handling of my case. The Agency responded on January 8, 2026. Unsatisfied with the Agency’s response, Ms. Lynch petitioned this office and this appeal, SPR26/0338, was opened as a result. Subsequent to the opening of this appeal, I learned that the Agency provided a further response on February 2, 2026. Where this appeal was opened based on the Agency’s January 8, 2026 response, I will now consider this administrative appeal closed. If unresolved issues remain, Ms. Lynch may appeal the substantive nature of the Agency’s February 2nd response within ninety (90) days. See 950 C.M.R. 32.08(1).
