See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 12, 2026, Mr. Dwan requested, all documents related to the operation of a state police helicopter over downtown Boston on January 10, 2026 between the hours of 11am and 5pm. I am specifically requesting: [1] The flight plan for this helicopter on this day. [2] Records indicating the names, titles, and roles of the staff operating the helicopter. [3] Notifications of no-fly zones or other airspace restrictions over Boston related to this flight. [4] Mission plans, operational goals and rules of engagement for this flight. [5] After action reports, memoranda, summaries, or similar documents related to this flight. [6] Any photographic, video, audio, biometric, or other records captured during this flight. [7] Any audio, text, or other communication exchanged between the operators of the helicopter and their ground control/leadership. Claiming to not yet have received responsive records, Mr. Dwan petitioned this office and this appeal, SPR26/0370, was opened as a result. Where this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed.
