See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 7, 2026, Ms. Valentino requested “all audio relating to the incident in the attachment below … the incident occurred at [an identified location] around 2 PM on December 16.” Previous Appeal The requested records were the subject of a previous appeal. See SPR26/0208 Determination of the Supervisor of Records (February 3, 2026). In my February 3rd determination, I found that no violation of G. L. c. 66, § 10 had been asserted by Ms. Valentino in her appeal. The Department responded on February 4, 2026, and assigned reference number 2026-0026 to this request. Unsatisfied with the Department’s response, Ms. Valentino petitioned this office and this appeal, SPR26/0419, was opened as a result. Subsequently, I learned that the Department provided Ms. Valentino with a supplemental response on February 10, 2026. Where this appeal was opened as a result of the Department’s February 4th response, I will now consider this administrative appeal closed. Ms. Valentino may appeal the substantive nature of the Department’s February 10th response within ninety days. See 950 C.M.R. 32.08(1).
