See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Powers SPR26/0448 Page 2 February 18, 2026 [q] [An identified individual][;] [r] Any other tobacco control contractors[;] [3] All documents related to the development, drafting, consideration, or adoption of Nicotine-Free Generation policies, including model ordinances, presentations, technical assistance materials, and legal analysis[;] [4] All contracts, agreements, MOUs, and payment records with tobacco control contractors, specifically including Hampshire Public Health Shared Services Collaborative, Mystic Valley Public Health Coalition, [an identified individual], Belchertown Board of Health, [an identified individual], Massachusetts Health Officers Association, Massachusetts Association of Health Boards, Massachusetts Municipal Association[;] [5] All grant application and awards related to tobacco control from the Massachusetts Department of Public Health, Centers for Disease Control and Prevention, or private foundations. The City responded on February 2, 2026. Unsatisfied with the response, Mr. DiCenzo petitioned this office and this appeal, SPR26/0448, was opened as a result. In an email to this office on February 18, 2026, Mr. DiCenzo stated, “I will not be filing an appeal at this time.” Accordingly, I will consider this administrative appeal closed.
