See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 14, 2026, Mr. Kim requested the following documents: [1] All communications between Wentworth Institute of Technology and MCPHS University that were shared with or transmitted to any Massachusetts governmental agency, concerning me; [2] All records relating to any investigation, inquiry, or disciplinary review referencing me, including the 2024 fantasy-football-related matter, to the extent such records were provided to or discussed with any governmental entity; [3] All communications between Wentworth Institute of Technology and any law enforcement or governmental entity referencing me; [4] Any documents identifying the basis for WIT’s asserted jurisdiction over matters involving a non-student that were communicated to or relied upon by any governmental entity. Claiming to not yet have received responsive records, Mr. Kim petitioned this office and this appeal, SPR26/0480, was opened as a result. The Supervisor of Records is statutorily empowered with the authority to determine the public record status of government records within the Commonwealth of Massachusetts. G. L. c. 66, § 10. The Wentworth Institute of Technology is a private entity, which is outside of the Public Records Law. Where the custodian of the requested records falls outside of the Massachusetts Public Records Law and the authority of this Office, I am unable to assist you in this matter.
