See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 20, 2026, Mr. Lougee requested the following records regarding an identified incident[:] [1] Tow call logs and recordings – Provincetown tow yard and any other tow vendors [including] [a]ny call logs reflecting calls made or received by the Provincetown Police Department to/from the Provincetown tow yard (and any other tow vendor(s)) related to [an identified incident], [a]ny available recordings of those calls, voicemails, or dispatch telephone recordings, [and][a]ny CAD/dispatch notes that document these calls, including timestamps[;] [2] Tow authorization chain – who ordered, who relayed, what was said, and to whom[including][t]he identity of the person(s) who initiated and/or authorized the tow (officer(s), dispatcher(s), supervisor(s)), [t]he identity of the person(s) who contacted the tow company/vendor[;] [t]he communications (radio traffic, dispatch audio, CAD notes, emails, texts, internal messages, written tow sheets/impound forms) reflecting[:] the reason given for the tow, any selection decision as to which company/lot would be used, any discussion of whether a local tow was possible, and the instructions given to the tow vendor[;] [3] Basis for towing my vehicle to Orleans rather than the local Provincetown lot[;] [4] [A]ll records that explain[:] [w]ho determined my vehicle would be towed to Orleans[;] [w]hy the local Provincetown lot was allegedly “not used” in my One Ashburton Place, Room 1719, Boston, Massachusetts 02108 • (617) 727-2832• Fax: (617) 727-5914 sec.state.ma.us/pre • pre@sec.state.ma.us

Barbara Peters SPR26/0508 Page 2 February 19, 2026 case[;] [w]hat policy, contract, rotation list, directive, or availability issue governed the decision on May 12, 2025[;] [w]hat efforts (if any) were made to arrange a local tow, especially after I advised I had just moved to town and could not afford an expensive tow/impound outcome[;] [a]ny communications referencing the Town website’s public statements about towing/impound arrangements and the actual practices used in my case[;] [5] Related dispatch materials [including] CAD logs, call-for-service logs, incident number references, and dispatch audio for the stop/arrest/tow sequence[;][a]ny tow/impound sheets, inventory forms, and chain-of-custody documentation[.] Claiming to not yet have received responsive records, Mr. Lougee petitioned this office and this appeal, SPR26/0508, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response. Accordingly, the Department is ordered to provide Mr. Lougee with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us.
