The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records February 20, 2026 SPR26/0576 Lieutenant James Cummings Records Access Officer Falmouth Police Department 750 Main Street Falmouth, MA 02540 Dear Lieutenant Cummings I have received the petition of Jessica O’Brien appealing the nonresponse of the Falmouth Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 28, 2025, Ms. O’Brien requested, “the police report for Case #25-023981 dated August 28, 2025.” Claiming to not yet have received a response, Ms. O’Brien petitioned this office and SPR26/0576, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response. As such, the Department is ordered to provide Ms. O’Brien with a written response. Said response must be made in accordance with the Public Records Law, its Regulations and this order within ten business days. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Ms. O’Brien may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1).
