See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 3, 2026, Mr. Miklin requested “a copy of the awarded contract for the ‘UMass Chan Medical School Fitness Center Management’ services, awarded in 2025/2026 under Request For Proposal Event Number / UMWOR-2025- 0893[.]” Specifically Mr. Miklin sought: [1] A copy of the winning proposal submission[;] [2] A copy of the executed contract or agreement[;] [3] Copies of all other proposals and documents (less Aquila), final discussions, best and final discussions, submitted in response to the related solicitation[;] [4] Evaluation/selection score sheets, documentation used in the award decision[.] Claiming to not yet have received a response, Mr. Miklin petitioned this office and this appeal, SPR26/0578, was opened as a result. Subsequently, I learned that the University intends on providing a written response to Mr. Miklin. Accordingly, the University is ordered to provide Mr. Miklin with said response in accordance with the Public Records Law, its Regulations and this order within ten business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Miklin may appeal the substantive nature of the University’s response within ninety days. See 950 C.M.R. 32.08(1).
