Assistant District Attorney Records Access Officer Norfolk County District Attorney’s Office 45 Shawmut Road Canton, MA 02021 Dear Attorney Hunt: I have received the petition of Kyle Sharkey appealing the nonresponse of the Norfolk County District Attorney’s Office (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 17, 2026, Mr. Sharkey requested records related to an identified criminal case. Specifically, Mr. Starkey sought, “[a]ll emails used by [a named indididual] private EMAIL- nfk.wmv@icloud.com Jan 29,2022- Present[.] To or from any public officer, MSP officer, Canton PD officers Boston Police Department, Department of Justice, Attorney General Emails used for work as his role as Norfolk DA Some emails have already been released, I request a broader search for more[.]” Claiming to not yet have received a response, Mr. Sharkey petitioned this office and this appeal, SPR26/0608, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Office has provided a response. Accordingly, the Office is ordered to provide Mr. Sharkey with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Sharkey may appeal the substantive nature of the Office’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
