G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 12, 2026, Mr. Snell, Jr. requested: The following public records from March 2025 to present from the Department of Corrections: [1] Any and all information, materials, letters, emails, notes, memorandum or any other communication between any DOC administrator and facility cohorts in Shirley or anywhere else, specific to [an identified individual] regarding “qualified handicapped individual” status; [2] All information, material, communication, memorandum, notes or email concerning [an identified individual], and the discontinuation of his single-cell status in housing unit A-2, particularly, any between [four identified individuals]; [3] Any and all communication, emails, memorandum, notes, letters, faxes or anything concerning [an identified individual] between [six identified individuals] or anyone else, specific to any action taken against [an identified individual]; [4] Any and all communications regarding [an identified individual] as to disciplinary action on or about 12/11/2025 instigated by [three identified individuals], or any other DOC cohort, including but not limited to either any Shirley supervisor abobe [SIC] the rank of corrections officer; as well as, any Milford DOC agents, or any DOC servant at the Norfolk Central Disciplinary Office; [5] Provide any and all information, material and any other paper specific to [an identified individual] and his separation from the United States navy, i.e.,… One Ashburton Place, Room 1719, Boston, Massachusetts 02108 • (617) 727-2832• Fax: (617) 727-5914 sec.state.ma.us/pre • pre@sec.state.ma.us Kate Silvia SPR26/0634 Page 2 February 25, 2026 Claiming to not yet have received a response, Mr. Snell, Jr. petitioned this office and SPR26/0634 was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response. As such, the Department is ordered to provide Mr. Snell, Jr. with a written response. Said response must be made in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Snell, Jr. may appeal the substantive nature of the Department’s response within ninety days.
