The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records February 27, 2026 SPR26/0656 Elizabeth Lawrenson Town Clerk Town of Lynnfield 55 Summer Street Lynnfield, MA 01940 Dear Ms. Lawrenson: I have received the petition of Taylor Donahoe, Esq., of McGregor Law Group, appealing the nonresponse of the Town of Wilmington (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 28, 2026, Attorney Donahoe requested the following: [1] [P]ublic records related to any and all digital or hard copy documents of the Town of Wilmington (the “Town”) or the Wilmington Board of Health (the “Board of Health”) regarding Harriman Tannery, that tannery and related facilities and properties (the “Tannery”) formerly located at [an identified address] and along [an identified address][;] [2] [P]ublic records related to any and all digital or hard copy documents of the Town and/or Board of Health regarding recent digging and presumed soil testing observed on the Site, in particular but not limited to such actions observed on December 24, 2025; December 29, 2025; December 30, 2025; and January 5, 2025; (the “Digging”). The Digging included two deep holes dug with an excavator, three holes dug along the border of the Site along the tree line, replacement of large pipes, and the import and placement of topsoil into the holes that were dug[;] [3] [P]ublic records related to any environmental site assessments or other environmental testing completed on the Site, as well as any soil tests completed as a part of the the [sic] Module 4 Schematic Design submission to the Massachusetts School Building Authority (the “MSBA”), as submitted on May 1, 2025 (the “MSBA Submission”)[;] One Ashburton Place, Room 1719, Boston, Massachusetts 02108 • (617) 727-2832• Fax: (617) 727-5914 sec.state.ma.us/pre • pre@sec.state.ma.us

Elizabeth Lawrenson SPR26/0656 Page 2 February 27, 2026 [4] [A]ll documents relating to the Tannery and all records of contamination from the Tannery at the Site, as well as any results of soil testing and/or any result obtained from the Digging on the Site [including but not limited to][:] any studies, drafts, reports, or plans produced by any employees of the Tannery or the Town or submitted to local or state agencies, boards, departments or divisions[;] [5] [A]ll written records, records stored in a computer medium, all non-identical drafts, and related e-mail on the computer system of the Town of Wilmington and/or the Board of Health and on the “personal” computers and mobile devices of the Town of Wilmington and/or the Board of Health employees and contractors, to the extent that those computers or electronic devices were used to collect, assemble or maintain information in connection with official Town of Wilmington and/or Board of Health business relating to the Tannery or the Digging. This includes, but is not limited to, the following: emailing, drafting letters, correspondence, notes, memoranda, reports, and other documents; visiting websites’ and downloading photographs, plans, reports, studies, and guidance documents. This request extends to both current and former Town of Wilmington and/or Board of Health employees and officials [including but not limited to the following][:] [a] Any and all records, communications, proceedings, orders, or plans on the subject of the Tannery[;] [b] Any and all analyses, opinions, measurements, or reports produced or received by the Town of Wilmington or Board of Health, on the subject of the Digging on the Site or other contamination from the Tannery[;] [c] Any and all records, communications, or plans related to any environmental site assessments or other environmental testing completed on the Site[;] [d] Any and all analyses, opinions, measurements, results, or reports produced or received by the Town of Wilmington or Board of Health, regarding the soil tests completed for the MSBA Submission[;] [e] Any and all communications by and between the Town or Wilmington, Board of Health, consultants, contractors, and/or employees and owners of the Tannery, on the subject of contamination from the Tannery and/or the Digging on the Site[.] Claiming to not yet have received responsive records, Attorney Donahoe petitioned this office and this appeal, SPR26/0656, was opened as a result. Subsequently I learned that the Town intends on providing a written response to Attorney Donahoe. Accordingly, the Town is ordered to provide Attorney Donahoe with said response in

A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us.
