The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records March 13, 2026 SPR26/0736 Helen Rush-Lloyd Records Access Officer Department of Public Health 250 Washington Street Boston, MA 02108 Dear Ms. Rush-Lloyd: I have received the petition of Elizabeth McEvoy, Esq. appealing the nonresponse of the Department of Public Health, Bureau of Health Professionals (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 6, 2026, Attorney McEvoy requested, “all public records relating to or made in deliberation of [an identified case] or any related complaints or BORID files, including but not limited to all records of executive sessions of the BORID meetings at which this matter was discussed[.]” Specifically, Attorney McEvoy sought the following: [1] All investigative reports and drafts relating to [an identified case][;] [2] All materials presented to, discussed, and/or considered by the BORID at any meeting where [an identified case], including all preceding and/or subsequent complaints/files and the substance thereof, was discussed[;] [3] All correspondences and communications regarding [an identified case] and/or [an identified individual][;] [4] All materials provided to and/or received from the BORID’s expert witness in [an identified case], [an identified individual], including all documents upon which [an identified individual’s] opinion is based or otherwise informed[;] [5] All other material provided to, exchanged among, and/or created by the BORID in connection with [an identified case] or any preceding and/or subsequent complaints/files or the substance thereof[.] One Ashburton Place, Room 1719, Boston, Massachusetts 02108 • (617) 727-2832• Fax: (617) 727-5914 sec.state.ma.us/pre • pre@sec.state.ma.us Helen Rush-Lloyd SPR26/0736 Page 2 March 13, 2026 Claiming to not yet have received responsive records, Attorney McEvoy petitioned this office and this appeal, SPR26/0736, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response. Accordingly, the Department is ordered to provide Attorney McEvoy with a response to her request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Attorney McEvoy may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
