Assistant District Attorney Records Access Officer Norfolk District Attorney’s Office 45 Shawmut Road Canton, MA 02021 Dear Attorney Hunt: I have received the petition of Kyle Sharkey appealing the nonresponse of the Norfolk County District Attorney’s Office (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 1, 2026, Mr. Sharkey requested records related to an identified criminal case. Specifically, Mr. Sharkey sought the following records “found in Commonwealths [sic] Notice of Discovery 60”[:] [1] Copy of email to Special Prosector [sic] …, dated 2/17/25, (1 Pg)[;] [2] Copy of email to Special Prosector [sic] …, dated 2/9/25, (lpg)[;] [3] Copy of email to Special Prosector [sic] …, dated 2/24/25 3 pgs[;] [4] Copy of Voicemails for Special Prosector [sic] …, dated 2/25/25 (2 audio files)[.] Claiming to not yet have received a response, Mr. Sharkey petitioned this office and this appeal, SPR26/0925, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Office has provided a response. Accordingly, the Office is ordered to provide Mr. Sharkey with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Sharkey may appeal the substantive nature of the Office’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
