See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 27, 2026, Mr. Ferretti requested records in [an identified matter]: [1] The final executed settlement agreement that resolved the matter referenced above, including any attachment, exhibit, appendix, amendment, addendum, side letter, schedule, incorporated document, or other record executed as part of, incorporated into, or made part of the final settlement agreement[;] [2] All responsive records produced by the DPH pursuant to the above-referenced settlement agreement[;] [3] To the extent DPH contends that it does not possess the final executed settlement agreement, that the agreement is not within its custody or control, that the agreement is maintained only by another office or counsel, or that the agreement is exempt from disclosure, I separately and expressly request, under the Massachusetts Public Records Law as part of this same request, any and all public records that document the factual and legal basis for DPH’s position that it lacks a disclosable copy[.] Claiming to not yet have received a response, Mr. Ferretti petitioned this office and this appeal, SPR26/0956, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response. Accordingly, the Department is ordered to provide Mr. Ferretti with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days.
