The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records March 31, 2026 SPR26/0634 Kate Silvia Records Access Officer Department of Correction 50 Maple Street Milford, MA 01464 Dear Ms. Silvia: I have received the petition of William Tyree appealing the nonresponse of the Department of Correction (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 6, 2026, Mr. Tyree requested: [1] E-mails between the DOC, and Keefe Commissary Network, (KCN), a.k.a. Keefe Group, [an identified address]; also Keefe Commissary Network, [an identified address]; also Keefe, [an identified address]; also Keefe, [an identified address], [an identified individual], from Septem[b]er 10, 2024, until January 6, 2026, that dealt specifically, and only to movies that KCN, provides to the inmate population within the Massachusetts DOC; movies that KCN, provides to the inmate population within the Massachusetts DOC, to inmates, to rent on their SCORE-7 Tablets; this would include all Tablet Rental Movies that KCN, has ever made available to rent, and view on the MP3, MP4, SCORE-Tablets, since the MP3, and MP4 were first made available for purchase in the Massachusetts DOC[;] [2] All E-mails, hard copy documents, memorandum, policies, regulations that detail the “REFUND PROCEDURE” that is in place, and was created by KCN, to refund money to the Massachusetts DOC inmates, who pay the $16.00 per month, to “RENT” the games and music available on the SCORE-7 Tablet, but cannot access the games or music, because there is no WI-FI for days at a time -- I am looking for procedure to get a REFUND when the WI-FI goes down, and the games and music paid for ‘up-front’, cannot be accessed -- how do I get my money back? I have been told that it is [an identified individual], KCN, [an identified address]. If that is correct, please state so, and no further Records request on that is necessary. If, [an identified individual] is not the Massachusetts C.E.O., please provide either the Records, or name and address of the KCN C.E.O., in Massachusetts. Someone from KCN must be in charge of the KCN for Massachusetts, that is the Record, that I seek[;] [4] Records that reflect the LEGAL AUTHORITY that the DOC or KCN claim to have, to censor news sites on the SCORE-7, SIAM sites which have Yahoo News, USA Today; BBC, and other news sites. Pursuant to [an identified case], United States District Court Judge, [an identified individual], found that the DOC can regulate the movies shown in the DOC, and those movies are limited to movies Rated-G/PG/PG13. [An identified individual] also found that DOC inmates as a whole have a right under the First Amendment, to information and ideas, from those of any of the television channels, and never have. By censoring the new[s] sites on the SCORE-7 Tablet, the DOC has denied information and ideas, that no court has ever authorized. I seek RECORDS from the DOC Legal Division stating what Legal Authority the DOC has for censoring and banning news sites on the SCORE-7 Tablet; further, why am I being denied access to these news sites, which I have paid to access for more than one year so far – this is bait and switch. What LEGAL AUTHORITY does the DOC LEGAL DIVISION rely upon, to bait me into paying the RENTAL FEE of $16.00 per month, then censoring and banning the news from these news sites around the world? Those are the Legal Records that I am requesting. You may simply address this Records request, by having the DOC Legal Division provide a “letter” that addresses, and answers both questions; [5] Records which reflect who has the authority to place Rental Movies on the SCORE-7 Tablet, is it the DOC, or KCN? DOC Formal Grievance from [an identified individual]; [an identified individual]; and DOC Departmental Grievance Coordinator [an identified individual], [an identified grievance number], stated it was entirely up to KCN. I am requesting Records that specifically state which entity has the authority to place Rental Movies on the SCORE-7 Tablet at this time, and the official reply in [an identified grievance number], stated it was KCN. This Grievance remains the only official Record that I am aware of, which specifically identifies KCN, as the final word on what Rental Movies are placed on the SCORE-7 Tablet. Is this the only official Record on this question? If there are other Records which either support, or contradict this Grievance Reply, I am making an official request for them, at this time. Kate Silvia SPR26/1002 Page 3 March 31, 2026 Claiming to not yet have received a response, Mr. Tyree petitioned this office and SPR26/1002, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response. As such, the Department is ordered to provide Mr. Tyree with a written response. Said response must be made in accordance with the Public Records Law, its Regulations and this order within ten business days. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Tyree. may appeal the substantive nature of the Department’s response within ninety days.
