The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records March 23, 2026 SPR26/1012 Michael Tencellent Records Access Officer Department of Conservation and Recreation 251 Causeway Street Boston, MA 02114 Dear Mr. Tencellent: I have received the petition of Jesus Medina appealing the nonresponse of the Department of Conservation and Recreation (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 9, 2026, Mr. Medina requested the following: [A]ll records held by the Department of Conservation and Recreation (DCR) and the Massachusetts State Police (MSP) related to the temporary parking restriction and towing enforcement involving [an identified vehicle], on February 6, 2026 shortly after 6:00 PM, on [an identified street]” from February 1-7, 2026. Requested records include, but are not limited to: [1] [A]ny DCR temporary parking orders or permits related to the Winter Wonderland Festival[;] [2] [A]ny statutes, regulations, directives, or legal authority relied upon to enforce the temporary parking restriction[;] [3] [T]ow authorizations, requests, or dispatch records issued to Action Towing documentation showing the date, time, location and personnel responsible for posting any temporary signage[;] [4] [A]ny MSP enforcement logs, notes, incident reports, or related records concerning this tow[.] Claiming to not yet have received responsive records, Mr. Medina petitioned this office and this appeal, SPR26/1012, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us.
