The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records March 27, 2026 SPR26/1074 Debra Cabral Administrative Assistant to the School Committee Fall River Public Schools 417 Rock Street Fall River, MA 0272 Dear Ms. Cabral: I have received the petition of Joey Ford, of Parent Data Force, appealing the nonresponse of the Fall River Public Schools (School) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 6, 2026, Mr. Ford requested records “related to Silvia Elementary School … [regarding] safety incidents, staffing practices, and behavioral interventions involving students during the 2024–2025 and 2025–2026 school years[.]” Specifically, Mr. Ford sought the following: [1] Incident Reports[:] All incident reports, behavioral incident reports, and safety reports generated at Silvia Elementary School from August 1, 2024 to present, including but not limited to incidents involving[:] physical aggression[;] classroom destruction[;] evacuation of classrooms[;] [and] threats to student or staff safety[.] Records should include any written reports, electronic reports, or internal safety documentation[;] [2] Physical Restraint Reports[:] All reports and documentation required under 603 CMR 46.06 relating to the use of physical restraint at Silvia Elementary School from August 1, 2024 to present, including[:] [A] [R]estraint incident reports[;] [B] [A]dministrative review documentation[;] [C] [P]arent notification records[;] [and] [D] [R]estraint logs maintained by the school or district[;] [3] Behavioral Incident Data[:] Any internal summaries, tracking spreadsheets, or behavioral data logs used by administrators to track student behavioral incidents at Silvia Elementary School for the 2024–2025 and 2025–2026 school years[;] One Ashburton Place, Room 1719, Boston, Massachusetts 02108 • (617) 727-2832• Fax: (617) 727-5914 sec.state.ma.us/pre • pre@sec.state.ma.us

Debra Cabral SPR26/1074 Page 2 March 27, 2026 [4] Staffing Assignments[;] Records showing staffing assignments for paraprofessionals and classroom support staff at Silvia Elementary School for the 2024–2025 and 2025–2026 school years, including[:] [A] [P]araprofessional assignment lists[;] [B] [C]lassroom staffing schedules[;] [C] [S]taffing allocation documents for special education classrooms[;] [5] IEP Service Staffing[:] Records showing how staffing was allocated to support IEP service delivery, including[:] [A] [S]taffing plans[;] [B] [S]pecial education classroom support assignments[;] [C] [P]araprofessional allocation documents[;] [6] Communications Regarding the February 4, 2026 Incident[:] All emails, internal communications, and administrative correspondence referencing the February 4, 2026 classroom incident at Silvia Elementary School, including communications involving[:] the school principal [;] assistant principals[;] school adjustment counselors[;] district administration[;] [and] human resources personnel[.] Search terms should include[:] “February 4”[;] “incident”[;] “Silvia”[;] “classroom evacuation”[;] “behavior incident”[;] [7] Radio Communication or Emergency Response Logs[:] Any records, logs, or documentation showing radio calls, emergency calls, or requests for administrative assistance at Silvia Elementary School on February 4, 2026[.] [8] Crisis Response Policies[:] Any written policies or procedures used by Silvia Elementary School or Fall River Public Schools regarding[:] behavioral crisis response [;] classroom evacuation procedures[;] [and] administrative response protocols during safety incidents[;] [9] Paraprofessional Training Records[:] Records describing training provided to paraprofessionals related to[:] crisis intervention[;] behavioral de-escalation[;] [and] restraint prevention training required under 603 CMR 46.00[;] [10] Administrative Incident Response Protocols[:] Any written procedures, guidance, or policies governing how school administrators are expected to respond to classroom safety incidents or requests for assistance[.] Claiming to not yet have received responsive records, Mr. Ford petitioned this office and this appeal, SPR26/1074, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the School has provided a response. Accordingly, the School is ordered to provide Mr. Ford with a response to his request, provided in a manner consistent with this order, the Public Records Law

It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Ford may appeal the substantive nature of the School’s response within ninety (90) days.
