Assistant District Attorney Records Access Officer Norfolk District Attorney’s Office 45 Shawmut Road Canton, MA 02021 Dear Attorney Hunt: I have received the petition of Kyle Sharkey appealing the nonresponse of the Norfolk County District Attorney’s Office (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 19, 2026, Mr. Sharkey sought the following records “[i]n relation to [an identified individual] Norfolk County [an identified case]”[:] [1] GPS/Tracking Data from Troopers Work phones dates noted below (allow 4 hours) (MSP has confirmed these phones were given to the troopers by the NDAO-see below)[;] [2] GPS/Tracking Data from Troopers work vehicles dates noted below (this was provided to me by the MSP- DISREGARD)[:] [A] Any photos that may have been taken on that day (Allow 4 hours)[;] [B] Any texts messages that happened on these days (Allow 4 hours)[;] [C] If GPS data was turned off on their phones during these days I would request a reason why and who authorized them to have them off[.] Jan 29, 2022 – [two identified individuals] Feb 3, 2022- [two identified individuals] Feb 4, 2022- [two identified individuals] Feb 8, 2022- [two identified individuals] Feb 10, 2022- [two identified individuals] Feb 11, 2022- [two identified individuals] Feb 18, 2022- [two identified individuals][.] Claiming to not yet have received a response, Mr. Sharkey petitioned this office and this appeal, SPR26/1228, was opened as a result. Accordingly, the Office is ordered to provide Mr. Sharkey with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us.
