Collins, Esq., of the Law Office of Bruce A. Collins, appealing the nonresponse of the Town of Becket (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 16, 2026, Attorney Collins requested the following: [1] The septic system permit(s) for the property located at [an identified address][;] [2] Any and all requests for variances related to [an identified address][;] [3] The audio recording of the March 11, 2025, Board of Health meeting (for which minutes do not appear to be publicly posted)[;] [4] Meeting minutes for the March 11, 2025 Board of Health meeting, if such minutes exist[;] [5] Any and all documentation related to the tight tank septic installation at [an identified address], including but not limited to[:] [A] Applications and permit applications[;] [B] Site plans and engineering drawings[;] [C] Soil evaluation reports and percolation test results[;] [D] Correspondence between the property owner, contractors, and the Board of Health[;] [E] Inspection reports and certificates of compliance[;] [F] Approvals, denials, or conditional approvals[;] [G] Any waivers or special permits granted[;] One Ashburton Place, Room 1719, Boston, Massachusetts 02108 • (617) 727-2832• Fax: (617) 727-5914 sec.state.ma.us/pre • pre@sec.state.ma.us

Susan Crossley SPR26/1236 Page 2 April 9, 2026 [H] Any complaints or violation notices[;] [I] All other records in the Board of Health’s possession related to this installation[.] Claiming to not yet have received responsive records, Attorney Collins petitioned this office and this appeal, SPR26/1236, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Town has provided a response. Accordingly, the Town is ordered to provide Attorney Collins with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us.
