Records Access Officer Department of Criminal Justice Information Services 200 Arlington Street, Suite 2200 Chelsea, MA 02150 Dear Attorney Koulouris: I have received the petition of Jessica Svagdis, of the Suffolk University Law School Immigrant Justice Clinic, appealing the nonresponse of the Massachusetts Department of Criminal Justice Information Services (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 24, 2026, Ms. Svagdis requested the following: [1] A comprehensive list of all federal Originating Agency Identifiers (“ORIs”) currently validated and authorized to access Massachusetts state data via the CJIS Broker and Nlets systems, specifically identifying those belonging to the Department of Homeland Security (“DHS”) divisions including but not limited to[;] [a] Homeland Security Investigations (“HSI”)[;] [b] Enforcement and Removal Operations (“ERO”)[;] [c] Customs and Border Protection (“CBP”)[;] [2] Copies of any and all written agreements, certifications, or assurances provided to DCJIS by HSI, CBP, or by the parent agency DHS pursuant to 940 CMR 37.04(7) and (8) certifying that disclosed RMV data will not be used for federal civil immigration enforcement purposes[;] [3] The number of responses to requests/ queries of Nlets data via CJIS Broker, by each OIR corresponding to a federal agency, in the following categories: Driver License Queries (“DQ”), Drivers License Query by Name (“DNQ”), Immigration Alien LESC query (“IAQ”), License Plate Reader Query (LPQ), Vehicle Registration Query (“RQ”), Vehicle Registration Query by Name (“RNQ”)[;] One Ashburton Place, Room 1719, Boston, Massachusetts 02108 • (617) 727-2832• Fax: (617) 727-5914 sec.state.ma.us/pre • pre@sec.state.ma.us

SPR26/1266 Page 2 April 10, 2026 [4] Any and all internal guidance, policies, protocols, or memorandum governing how DCJIS processes, evaluates, and tracks requests or automated queries for driver data or information submitted by HSI and CBP through the CJIS Broker[;] [a] This request specifically includes records setting forth the criteria, standards, or decision-making framework applied by DCJIS (including any staff, officials, or units) in determining whether to release such information, as well as records reflecting any instances in which DCJIS denied or declined to release information to HSI or CBP, including the stated basis or justification for each such denial[.] Claiming to not yet have received responsive records, Ms. Svagdis petitioned this office and this appeal, SPR26/1266, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response. Accordingly, the Department is ordered to provide Ms. Svagdis with a response to her request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us.
