See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 19, 2026, Mr. Rodrigues requested the following: [1] Records reflecting MSP’s access to driver data pursuant to its authority under 940 CMR 37.04, including[;] [a] The number of individuals for whom MSP obtained RMV driver data because RMV made a fraud allegation[;] [b] The types of information MSP obtained[;] [2] Records reflecting any direct sharing of RMV driver data between MSP and immigration enforcement agencies, including ICE Enforcement and Removal Operations (ERO), Homeland Security Investigations (HSI), and U.S. Customs and Border Protection (CBP), outside of the automated Nlets portal, including[;] [a] The number of instances in which MSP has directly shared driver data with each immigration enforcement agency[;] [b]The type of RMV driver data shared in such instances[;] and[;] [c] Any memoranda of understanding, data-sharing agreements, policies, protocols, or standard operating procedures governing MSP’s direct sharing of the RMV driver data with immigration enforcement agencies outside of the Nlets portal[;] [3] Records reflecting and direct requests made by immigration enforcement agencies including HIS, ERO, or CBP outside of the Nlets portal including[;] [a] The number of instances in which immigration enforcement agencies requested driver data from MSP[;] [b] The types of data requested[;] One Ashburton Place, Room 1719, Boston, Massachusetts 02108 • (617) 727-2832• Fax: (617) 727- 5914 sec.state.ma.us/pre • pre@sec.state.ma.us

Allison Mondello SPR26/1287 Page 2 April 10, 2026 [c] Any memoranda of understanding, data-sharing agreements, policies, protocols, or standard operating procedures governing MSP’s responses to requests for driver data from immigration enforcement agencies[;] [4] Records reflecting queries made by immigration enforcement agencies, including ICE ERO, HSI, and CBP to RMV driver data through the Nlets portal via MSP’s systems or personnel including[;] [a] Any logs, audit trails, or summaries of such queries, reported separately by the agency with personal information redacted[;] [b] The types of RMV driver data returned in response to such queries[;] and[;] [c] Any limitations applicable to immigration enforcement agencies’ queries via MSP systems, RMV driver data through the Nlets portal, including any blocked placed on Originating Agency Identifiers (ORI) associated with immigration enforcement agencies, and the dates on which any such limitations were implemented[.] Claiming to not yet have received responsive records, Mr. Rodrigues petitioned this office and this appeal, SPR26/1287, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response. Accordingly, the Department is ordered to provide Mr. Rodrigues with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us.
