Assistant City Solicitor City of New Bedford 133 William Street, Room 203 New Bedford, MA 02740 Dear Attorney Schuko: I have received the petition of Commonwealth Transparency (requester) appealing the nonresponse of the City of New Bedford (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 31, 2026, the requester sought the following records between January 1, 2023 and February 6, 2026: Any insurance policy(ies), including declarations pages, exclusions, list(s) of covered locations and values, and/or any other documents in your possession or under your control for the risks of loss related to torts: theft of, damage to and destruction of assets; errors and omissions; and natural disasters[.] This request specifically includes but is not limited to policies for the following specific perils/coverages[:] Common Contract Conditions; Auto Liability; Auto Physical Damage; Cyber Liability Coverage; General Liability; Property; Crime; Equipment Breakdown; Public Officials Liability; Law Enforcement Liability; School Board Liability; Workers’ Compensation; Umbrella/Excess Liability[.] Claiming to not yet have received responsive records, the requester petitioned this office and this appeal, SPR26/1433, was opened as a result. In an email correspondence on April 17, 2026, the requester informed this office that they wish to withdraw their appeal. Accordingly, I will consider this administrative appeal closed.
