G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv); see also 950 C.M.R. 32.06(4). As required by law, it is my understanding that the Town furnished a copy of the petition to the requestor, Sudhir Shandilya. G. L. c. 66, § 10(c); G. L.c. 66, § 10(d)(iv)(2). On April 17, 2026, Mr. Shandilya requested the following: [1] All site inspection notes, photographs, videos, field reports, emails, text messages, and other records relating to the Town’s inspection conducted on or about April 17, 2026 of the no-disturb / buffer area behind … America Boulevard and adjacent to … Old Connecticut Path. [2] All records relied upon by the Director of Planning and Economic Development in reaching the determination communicated on April 17, 2026 that the owner was permitted to remove leaves and branches and that there was no violation on the site, including any legal opinions, Planning Board votes, staff memoranda, or written delegations of authority authorizing such determination[;] [3] The complete Planning Board file for the Village of the Americas subdivision, including but not limited to: the original definitive subdivision plan, any site plan approvals, special permits, endorsed plans, as-built plans, covenants referenced in the approval, and all conditions of approval relating to open space, buffer areas, or no-disturb zones[;] [4] The 2008 Zoning Board of Appeals decision and complete ZBA file concerning the Village of the Americas, as referenced in the Town’s published “Village of the Americas History Memo”[;] One Ashburton Place, Room 1719, Boston, Massachusetts 02108 • (617) 727-2832• Fax: (617) 727-5914 sec.state.ma.us/pre • pre@sec.state.ma.us

Cynthia Livingstone SPR26/1513 Page 2 April 28, 2026 [5] Any written authorization, waiver, interpretation, approval, policy, or guidance document identifying what activities are permitted or prohibited within the 100- foot no-disturb zone established by the 2002 Covenant and/or Planning Board conditions, including with respect to: clearing of vegetation or leaves, removal of branches, mulching, movement or removal of rocks, installation or placement of objects, structures, or equipment (including recreational equipment), and recreational use of any kind[;] [6] All notices of violation, cease and desist letters, enforcement correspondence, complaints, and enforcement determinations issued by or received by the Planning Board, Director of Planning, Building Commissioner, or Conservation Commission concerning the no-disturb / buffer / open-space area of the Village of the Americas subdivision from January 1, 2002 to the present[;] [7] All internal Town correspondence, including emails, memoranda, and text messages, concerning the inspection, interpretation, complaints about, or enforcement position regarding the buffer area behind … America Boulevard. This includes communications among the Director of Planning, Conservation Agent, Building Commissioner, Town Administrator, Town Counsel, Planning Board members, and any outside consultants[;] [8] Any records reflecting similar clearing, landscaping, or recreational-use activities by other property owners within the Village of the Americas no-disturb zone, and the Town’s response or non-response to such activities, from January 1, 2015 to the present. Subsequently, in an email to the Town on April 22, 2026, Mr. Shandilya states, “I am writing to withdraw my request at this time.” In light of the above, it is unnecessary to opine on the Town’s Petition for an extension of time.
