Heredia appealing the nonresponse of the Boston Housing Authority (Authority) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 30, 2026, in six separate requests, Mr. Heredia requested the following: SPR26/1572 [The following records dated between January 1, 2024 and April 30, 2025][:] [1] Any and all policies, procedures, manuals, guidelines, or standard operating procedures relating to employee discipline, including but not limited to progressive discipline, warnings, suspensions, and termination[.] [2] Any and all policies, procedures, manuals, guidelines, or standard operating procedures governing Human Resources investigations, including employee misconduct investigations and reporting requirements[.] [3] Any and all policies or procedures regarding documentation, recordkeeping, or reporting of employee performance issues, complaints, or alleged misconduct[.] [4] Any policies, procedures, or internal guidelines identifying the steps required prior to termination of an employee[.] SPR26/1573 [1] All communications, including emails, internal messages, memoranda, or notes, from April 3, 2024 through June 30, 2025, referencing or relating to [an identified individual] specifically concerning my employment, discipline, or One Ashburton Place, Room 1719, Boston, Massachusetts 02108 • (617) 727-2832• Fax: (617) 727-5914 sec.state.ma.us/pre • pre@sec.state.ma.us Dean Papademetriou, Esq. SPR26/1572; SPR26/1573; SPR26/1574 Page 2 SPR26/1575; SPR26/1576; SPR26/1577 April 28, 2026 Termination[.] [2] All communications between Boston Housing Authority personnel and any union representatives or officials, including but not limited to Local 367 or affiliated representatives of the Laborers’ International Union of North America (LIUNA), relating to my employment, discipline, or termination[.] [3] Any communications, records, or documents involving or referencing the following individuals in connection with my employment, discipline, or termination[:] [six identified individuals][.] [4] Any internal memoranda, summaries, or reports reflecting discussions or decisions regarding my termination[.] SPR26/1574 [The following records dated between January 1, 2024 and April 30, 2025][:] [1] Any and all policies, procedures, manuals, guidelines, or standard operating procedures relating to employee discipline, including but not limited to progressive discipline, warnings, suspensions, and termination[.] [2] Any and all policies, procedures, manuals, guidelines, or standard operating procedures governing Human Resources investigations, including employee misconduct investigations and reporting requirements[.] [3] Any and all policies or procedures regarding documentation, recordkeeping, or reporting of employee performance issues, complaints, or alleged misconduct[.] [4] Any policies, procedures, or internal guidelines identifying the steps required prior to termination of an employee[.] SPR26/1575 Any and all records reflecting disciplinary actions, warnings, suspensions, or terminations issued to employees in positions similar to mine (including but not limited to Laborers, Custodians, and Mechanics) from January 1, 2024 to the present. This request includes, but is not limited to: [1] Written warnings[;] [2] Suspension notices[;] [3] Termination notices[;] [4] Records of corrective or progressive discipline[.] SPR26/1576 Any and all records related to any internal investigation concerning my employment and/or termination from the Boston Housing Authority[:] This request includes, but is not limited to[:] [1] Interview notes[;] Dean Papademetriou, Esq. SPR26/1572; SPR26/1573; SPR26/1574 Page 3 SPR26/1575; SPR26/1576; SPR26/1577 April 28, 2026 [2] Witness statements[;] [3] Investigator notes[;] [4] Internal memoranda[;] [5] Findings, conclusions, or reports[;] [6] Any documents reflecting the initiation or scope of the investigation[.] SPR26/1577 Any and all communications between representatives of the Boston Housing Authority and any union representatives concerning my employment, discipline, or termination [between January 1, 2025 and June 30, 2025][:] This request includes, but is not limited to[:] [1] Emails[;] [2] Text messages (if maintained)[;] [3] Letters or correspondence[;] [4] Internal communications referencing union involvement[.] Claiming to not yet have received a response, Mr. Heredia petitioned this office and these appeals, SPR26/1572, SPR26/1573, SPR26/1574, SPR26/1575, SPR26/1576, and SPR26/1577, were opened as a result. Subsequently, I learned that the Authority provided Mr. Heredia with a response on April 28, 2026. Where this appeal was opened as a result of the Authority’s lack of a written response, I will now consider this administrative appeal closed.
