Assistant Attorney General Records Access Officer Office of the Attorney General One Ashburton Place, 20th Floor Boston, MA 02108 Dear Attorney Rush: I have received the petition of John T. Mulcahy, Esq., of Nixon Peabody LLP, appealing the nonresponse of the Office of the Attorney General (AGO) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 6, 2026, Attorney Mulcahy requested, “all communications, including, but not limited to, letter correspondence, email communications and text messages, between any employee of the Attorney General’s Office, including, but not limited to, [an identified individual], and [an identified individual], relating to the investigation of the death of [an identified individual] and/ or the possible prosecution of members of the Massachusetts State Police for [an identified individual]’s death[.]” Claiming to not yet have received responsive records, Attorney Mulcahy petitioned this office and this appeal, SPR26/1585, was opened as a result. Subsequently, I learned that the AGO provided Attorney Mulcahy with a response on April 8, 2026. Where this appeal was opened as a result of the AGO’s lack of a written response, I will now consider this administrative appeal closed.
