G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv); see also 950 C.M.R. 32.06(4). As required by law, it is my understanding that the City furnished a copy of the petition to the requestor, David Kantor. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv)(2). On June 9, 2026, Mr. Kantor requested the following records: For the period January 1, 2023 through the date of search, I am requesting the following records in the custody of the City of Boston concerning the adult whale and calf sculpture installation at or adjacent to Boston Children’s Hospital, 300 Longwood Avenue, including the front/valet entrance area: [1] Any applications, permit applications, or submissions to the City for installation, placement, approval, review, sidewalk use, right-of-way use, encroachment, construction, or site work related to the whale sculpture installation. [2] Any approvals, permits, licenses, votes, staff determinations, or written authorizations issued by the City for the installation, placement, site work, sidewalk/right-of-way use, or maintenance of the whale sculpture installation. [3] Any records submitted to or generated by the Boston Art Commission, Mayor’s Office of Arts and Culture, Public Improvement Commission, Public Works Department, Boston Transportation Department, Inspectional Services Department, or Planning Department/BPDA specifically related to approval, permitting, siting, installation, or maintenance of the whale sculpture installation. Grace Jung SPR26/2361 Page 2 June 26, 2026 [4] Records sufficient to identify the artist, fabricator, vendor, installer, applicant, owner, sponsor/donor, funding source, and party responsible for maintenance of the whale sculpture installation, to the extent such records are in City custody. [5] Correspondence between City employees and Boston Children’s Hospital, its representatives, the artist/fabricator/vendor/installer, or any project applicant, limited to correspondence specifically about City approval, permitting, siting, installation, ownership, maintenance responsibility, or funding/sponsorship of the whale sculpture installation. Conclusion Subsequent to the opening of this petition, I learned that Mr. Kantor narrowed the scope of his above request in an email to the City on June 23, 2026. In light of the decision to modify the scope of the request, I find it is unnecessary to opine on the City’s petition at this time.
