G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv); see also 950 C.M.R. 32.06(4). As required by law, it is my understanding that the City furnished a copy of the petition to the requestor, Brian DeLacey. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv)(2). On June 9, 2026, Mr. DeLacey requested, “all emails, along with any attachments, created by or received by any member of the City Council (or the address citycouncil@cityofmalden.org) - but does not include any member of the legal department in the email distribution list - which includes the text “PUBLIC HEARING” in the SUBJECT, BODY or ATTACHMENT from 3/1/26 to the date you receive this request.” In an email sent to the City on June 24, 2026, Mr. DeLacey stated, “[p]lease withdraw the underlying Malden public records request #2026-0254. This eliminates the need for the state’s further review of this matter under SPR26/2370.” In light of the above, I find it unnecessary to opine on the City’s petition at this time.
