The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Manza Arthur Supervisor of Records October 1, 2026 SPR26/4125 Jacquelyn Cronin City Clerk / Records Access Officer City of Fitchburg 718 Main Street Fitchburg, MA 01420 Dear Ms. Cronin: I have received the petition of Jacquelyn Wehtje appealing the nonresponse of the City of Fitchburg (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 14, 2026, Ms. Wehtje requested “… a copy of the ledger, electronic or otherwise, for any account or sub account that holds funds received from Unitil for road paving, for the time period from 12/31/23 through today 9/24/26, showing:” the following: [1] Beginning balance[;] [2] Deposits into [the] account (with any notations such [as] the street they are earmarked for)[;] [3] Withdrawals from the account (with any notations, such as were they used to pave a specific street or transferred to the DPW general budget), and [e]nding/ current balance[.] Claiming to not yet have received responsive records, Ms. Wehtje petitioned this office and this appeal, SPR26/4125, was opened as a result. Subsequently, I learned that the City provided Ms. Wehtje with a response on October 1, 2026. Where this appeal was opened as a result of the City’s lack of a written response, I will now consider this administrative appeal closed. Ms. Wehtje may appeal the substantive nature of the City’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
